PRIVACY NOTICE

All Points Bay Property Management, with address at Calle 16 de Septiembre No. 11, Bucerías Centro, C.P. 63732, Bucerías, Nayarit, Mexico (“APB”, “we”), is the controller (responsable) of your personal data under Mexico’s Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP).

Data we process. Identification and contact data (name, email, phone, address); data about your managed property(ies); tax data (RFC) and billing data, including bank account (CLABE) for collection and disbursement; and free-text operational notes attached to your record (communications, incidents, and service follow-up), recorded with date and author.

Sensitive personal data. We do not process sensitive personal data. None of the purposes stated in this notice requires it, we do not request it, and we ask you not to provide it. If information of this nature should nonetheless reach your records by any route — for example, within a free-text note — it will not be used for any purpose other than those stated, will be limited to the minimum indispensable period, and you may at any time request its rectification or cancellation under the ARCO rights section below.

Purposes. All of the following purposes are necessary for the legal relationship between you and us and for our compliance with legal obligations, and therefore do not require your consent (LFPDPPP Article 9, sections I and IV): (1) provide the contracted property-management service; (2) issue invoices and manage collections and payments; (3) coordinate work orders, inspections, and maintenance; and (4) comply with applicable tax and legal obligations.

Your financial and patrimonial data (RFC, CLABE) are processed under the exception in LFPDPPP Article 9, section IV, being necessary to fulfil the legal relationship between us.

We do not process your data for optional purposes (for example, marketing, advertising, or commercial prospecting). Should we intend to do so in future, we would inform you through an updated notice and obtain your consent beforehand.

Options and means to limit the use or disclosure of your data. You may at any time request that we limit the use or disclosure of your personal data by sending your request to james@allpointsbay.com. We will record your request, apply the corresponding limitation, and confirm the measure taken to you in writing, within the periods stated in the ARCO rights section.

Processing abroad (processors). Your data is stored and processed on infrastructure located in the United States (San Francisco / SFO3 region, provider DigitalOcean). For document generation and bounded field extraction we use an AI processor (Anthropic), which receives only delimited fields — never raw, uncontrolled documents — under human verification. Both providers act as processors (encargados), that is, they process the data on our behalf and under our instructions (LFPDPPP Article 2, section XII), so their involvement does not constitute a transfer within the meaning of Article 2, section XX, of that Law. Our relationship with each processor is governed by a data-processing agreement (DPA). We disclose this location and these processors for transparency, even though the Law does not require it.

Transfers to third parties. We do not transfer your personal data to third parties other than the processors identified above, except where legally required. Should we intend to make a transfer requiring your consent in future, we would inform you beforehand and obtain your acceptance.

Retention. We retain your data only as long as necessary for the stated purposes. Records with fiscal effect (invoices, payments, RFC) are retained for the period required by applicable tax legislation. Data that may serve to determine liabilities arising from the legal relationship is retained blocked — not subject to any processing — for the corresponding prescription period (LFPDPPP Article 2, section III). Once the purposes are fulfilled and those periods end, the data is suppressed, following prior blocking, in accordance with LFPDPPP Article 10. We are not obliged to cancel data in the cases set out in LFPDPPP Article 25 — among others, where the data is necessary for the performance and fulfilment of the contract or must be processed under a legal provision.

ARCO rights. You may exercise your rights of Access, Rectification, Cancellation, and Opposition by request to james@allpointsbay.com. Under LFPDPPP Article 28, your request must contain: your name and address, or any other means of receiving our response; documents evidencing your identity or, where applicable, that of your representative; a clear and precise description of the data concerned (except for the right of access); a description of the right you wish to exercise; and any element facilitating location of your data.

We will communicate our determination within a maximum of twenty days from receipt of your request and, if it is well founded, it will be made effective within the following fifteen days (LFPDPPP Article 31); both periods may be extended once where the circumstances justify it. Exercising these rights is free of charge; only reproduction, copying, or shipping costs may be charged (Article 34).

We operate these rights as: Access → export of your data in standard formats; Rectification → update with audit record; Cancellation → blocking followed by suppression per our retention schedule; Opposition → we record your request and cease the processing concerned, with written confirmation.

Revocation of consent. Where processing is based on your consent, you may revoke it at any time by sending your request to the same contact, by the same means and subject to the same requirements and periods as the ARCO rights. Revocation has no retroactive effect and does not affect processing we must continue by legal obligation or that is necessary for the legal relationship between us.

Personal-data responsible. We have designated James Roach (james@allpointsbay.com) to handle your requests and to promote personal-data protection within the organization (LFPDPPP Article 29).

Changes to this notice. We may amend this notice to reflect changes in our services, in applicable regulation, or in our processing practices. Any change will be published at allpointsbay.com/privacy-policy/, stating the date of last update; we recommend consulting it periodically. Where a change is substantial — for example, the addition of a new purpose — we will also notify you at the email address we hold on record, before the change takes effect.

AVISO DE PRIVACIDAD

All Points Bay Property Management, con domicilio en Calle 16 de Septiembre No. 11, Bucerías Centro, C.P. 63732, Bucerías, Nayarit, México (“APB”, “nosotros”), es el responsable del tratamiento de sus datos personales, conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP).

Datos que tratamos. Datos de identificación y contacto (nombre, correo, teléfono, domicilio); datos de su(s) propiedad(es) administrada(s); datos fiscales (RFC) y de facturación, incluyendo cuenta bancaria (CLABE) para fines de cobro y dispersión; y notas operativas de texto libre asociadas a su expediente (comunicaciones, incidencias y seguimiento de servicios), registradas con fecha y autor.

Datos personales sensibles. No tratamos datos personales sensibles. Ninguna de las finalidades señaladas en este aviso los requiere, no se los solicitamos y le pedimos no proporcionarlos. Si por cualquier vía llegara a incorporarse información de esta naturaleza a sus registros —por ejemplo, dentro de una nota de texto libre— no será utilizada para ninguna finalidad distinta de las señaladas, se limitará al periodo mínimo indispensable y usted podrá solicitar en todo momento su rectificación o cancelación conforme a la sección de Derechos ARCO.

Finalidades. Todas las finalidades siguientes son necesarias para la relación jurídica que mantenemos con usted y para el cumplimiento de obligaciones legales a nuestro cargo, por lo que no requieren su consentimiento (artículo 9, fracciones I y IV, de la LFPDPPP): (1) prestar el servicio de administración de propiedades contratado; (2) emitir facturas y gestionar cobros y pagos; (3) coordinar órdenes de trabajo, inspecciones y mantenimiento; y (4) cumplir obligaciones fiscales y legales aplicables.

Sus datos financieros y patrimoniales (RFC, CLABE) se tratan al amparo de la excepción prevista en el artículo 9, fracción IV, de la LFPDPPP, por ser necesarios para el cumplimiento de la relación jurídica que nos vincula.

No tratamos sus datos para finalidades voluntarias (por ejemplo, mercadotecnia, publicidad o prospección comercial). Si en el futuro pretendiéramos hacerlo, se lo informaríamos mediante un aviso actualizado y recabaríamos previamente su consentimiento.

Opciones y medios para limitar el uso o divulgación de sus datos. Usted puede solicitar en cualquier momento que limitemos el uso o la divulgación de sus datos personales, dirigiendo su solicitud a james@allpointsbay.com. Registraremos su solicitud, aplicaremos la limitación que corresponda y le confirmaremos por escrito la medida adoptada, dentro de los plazos señalados en la sección de Derechos ARCO.

Tratamiento en el extranjero (encargados). Sus datos se almacenan y procesan en infraestructura ubicada en los Estados Unidos de América (región San Francisco, SFO3, del proveedor DigitalOcean). Para la generación de documentos y la extracción de campos delimitados utilizamos un procesador de inteligencia artificial (Anthropic), que recibe únicamente campos acotados — nunca documentos completos sin control — bajo verificación humana. Ambos proveedores actúan como encargados, es decir, tratan los datos por nuestra cuenta y conforme a nuestras instrucciones (artículo 2, fracción XII, de la LFPDPPP), por lo que su intervención no constituye una transferencia en términos del artículo 2, fracción XX, de la misma Ley. La relación con cada encargado se rige por un acuerdo de tratamiento de datos (DPA). Le informamos de esta ubicación y de estos encargados por transparencia, aun cuando la Ley no lo exija.

Transferencias a terceros. No transferimos sus datos personales a terceros distintos de los encargados señalados, salvo cuando resulte legalmente exigible. Si en el futuro pretendiéramos realizar una transferencia que requiera su consentimiento, se lo informaríamos previamente y recabaríamos su aceptación.

Conservación. Conservamos sus datos solo durante el tiempo necesario para las finalidades indicadas. Los registros con efectos fiscales (facturas, pagos, RFC) se conservan por el plazo que exija la legislación fiscal aplicable. Los datos que puedan servir para determinar responsabilidades derivadas de la relación jurídica se conservan bloqueados —sin ser objeto de tratamiento— durante el plazo de prescripción que corresponda (artículo 2, fracción III, de la LFPDPPP). Cumplidas las finalidades y concluidos dichos plazos, los datos se suprimen, previo bloqueo, conforme al artículo 10 de la LFPDPPP. No estamos obligados a cancelar datos en los supuestos del artículo 25 de la LFPDPPP, entre otros, cuando sean necesarios para el desarrollo y cumplimiento del contrato o deban tratarse por disposición legal.

Derechos ARCO. Usted puede ejercer sus derechos de Acceso, Rectificación, Cancelación y Oposición mediante solicitud dirigida a james@allpointsbay.com. Conforme al artículo 28 de la LFPDPPP, su solicitud debe contener: su nombre y domicilio, o cualquier otro medio para recibir la respuesta; los documentos que acrediten su identidad o, en su caso, la de su representante; la descripción clara y precisa de los datos respecto de los que ejerce el derecho (salvo tratándose del derecho de acceso); la descripción del derecho que desea ejercer; y cualquier elemento que facilite la localización de sus datos.

Le comunicaremos la determinación adoptada en un plazo máximo de veinte días contados desde la recepción de su solicitud y, de resultar procedente, se hará efectiva dentro de los quince días siguientes (artículo 31 de la LFPDPPP); ambos plazos podrán ampliarse por una sola vez cuando las circunstancias del caso lo justifiquen. El ejercicio de estos derechos es gratuito; únicamente procede el cobro de los costos de reproducción, copias o envío (artículo 34).

Operamos estos derechos como: Acceso → exportación de sus datos en formatos estándar; Rectificación → actualización con registro de auditoría; Cancelación → bloqueo y posterior supresión conforme a nuestro calendario de conservación; Oposición → registro de su solicitud y cese del tratamiento señalado, con confirmación por escrito.

Revocación del consentimiento. Cuando un tratamiento se base en su consentimiento, usted puede revocarlo en cualquier momento dirigiendo su solicitud al mismo contacto señalado, por el mismo medio y con los mismos requisitos y plazos previstos para los derechos ARCO. La revocación no tendrá efectos retroactivos y no afectará aquellos tratamientos que debamos continuar por obligación legal o por ser necesarios para la relación jurídica que nos vincula.

Responsable de datos personales. Hemos designado a James Roach (james@allpointsbay.com) para dar trámite a sus solicitudes y fomentar la protección de datos personales al interior de la organización (artículo 29 de la LFPDPPP).

Cambios al aviso. Podemos modificar este aviso para reflejar cambios en nuestros servicios, en la normativa aplicable o en nuestras prácticas de tratamiento. Cualquier modificación se publicará en allpointsbay.com/privacy-policy/, señalando la fecha de la última actualización; le recomendamos consultarlo periódicamente. Cuando el cambio sea sustancial —por ejemplo, la incorporación de una nueva finalidad— se lo comunicaremos además al correo electrónico que tengamos registrado, antes de que el cambio surta efectos.
